New Filing Requirements for Passive Entities
Effective January 1, 2011, passive entities that are registered or required to be registered with either the Texas Secretary of State or the Comptroller’s office will be required to file an annual No Tax Due Information Report (Form 05-163) affirming that the entity qualifies as a passive entity for the period on which the tax is based.
